You or your spouse must be either (1) a domiciliary of Alabama or (2) be a military service member stationed in Alabama. In either scenario you or your spouse must be domiciled or stationed in Alabama for at least six months prior to filing the Petition for Divorce with the county court. You are domiciled in Alabama if you live in Alabama with the intention of making Alabama your permanent home. For example, where do you primarily live? Sleep at night? Get your mail? What address is on your driver's license? What address is on your federal tax return? If Alabama, then you are domiciled in Alabama. Military service members do not have to be domiciled in Alabama but simply stationed in Alabama. If you or your spouse is an Alabama resident and either of you is in the military or on government service, you are considered a domiciliary of Alabama if Alabama is your home state.
